These general terms and conditions of sale exclusively govern the sale of products offered on the site. Any contrary condition imposed by the buyer will therefore, in the absence of express acceptance, be unenforceable against the seller regardless of when it may have been brought to their attention. The fact that the seller does not rely on any of these general terms and conditions of sale at any given time cannot be interpreted as a waiver of the right to rely on any of said conditions at a later date.

Offers and Prices

All product offers proposed on the Site are limited to Metropolitan France and Corsica. Collines de Provence guarantees product availability for 24 hours. Promotional offers are only valid for the duration of the offer concerned.

The prices listed on this Site are indicated in Euros, inclusive of all taxes, excluding shipping or fulfillment costs (see Delivery), it being understood that ordered products are invoiced at the prices in effect at the time the order is registered. Our prices are updated once a year, on January 1st.

When placing an order for international delivery, please indicate your destination country during your visit to our site or provide your delivery address so that product prices and shipping fees can be updated. Please note that customs fees may apply for international deliveries and are beyond our control.

Products remain the exclusive property of Collines de Provence until full payment has been received by Collines de Provence.

For payments by check, products are not reserved until the check has been received. Only upon receipt of the check will we be able to confirm the availability of the selected products.

Additional costs (shipping fees and special packaging) will be specified to the consumer before validation of their order and are available in the "Delivery" section below.

Ordering and Transaction Validation

When you confirm your order by clicking on the "confirm" button, you declare your acceptance of this order as well as all of these general terms and conditions of sale, fully and without reservation. Your order is then processed so that you may receive your package. You may print your order form.

Upon registration of your order, a detailed acknowledgment of receipt will be sent to your email address. This acknowledgment will specify the exact amount invoiced and the delivery methods for your order. The issuance of your acknowledgment of receipt constitutes acceptance of your order and will validate the transaction. You agree that our order registration systems serve as proof of the nature of the agreement and its date.

We reserve the right, however, to cancel any order from a customer with whom there is a dispute regarding payment of a previous order.

Payment

Payment for your purchases on the Site is made exclusively in Euros and can be completed by check (drawn on a French bank), credit card, American Express, or Paypal.

Your order will be processed upon receipt of your check, which may occasionally increase the delivery time.

Payment by credit card: this is done online when placing the order and is entirely secure. The entire transaction is directed in encrypted mode to a bank validation server using SSL (Secure Socket Layer) mode. You thus make your purchases with complete security.

Payment by Paypal: this is done online when placing the order. It is secured by Paypal and also allows you to make your purchases with complete security.

Product Availability

Our product offers proposed on the Site are valid only while stocks last. Products that are out of stock will be identified on the Site and cannot be ordered.

Delivery

Our sales and prices are understood to be from Mane 04300, France. Products are delivered to all countries worldwide except the Netherlands, in accordance with the address of your choice as indicated during the ordering process. It is your responsibility to provide us with all the details necessary for the proper shipment of your order.

You will be delivered within an average of 5 to 10 days from receipt of your order form by Collines de Provence in Metropolitan France. For all other countries, delivery times may be extended for various reasons (customs clearance procedures, distant countries, etc.).

Your package is sent via postal service; we negotiate shipping costs on your behalf with La Poste. Shipping costs are free for all orders of 49 Euros or more in France, unless otherwise stated on the site. Delivery costs are your responsibility for any order under 49 Euros and correspond to the amounts defined below.

The available delivery methods and corresponding delivery times are:

  • Colissimo Pick-up points: Delivery to the post office, Pickup relay & Pickup Station lockers: €3.90 incl. VAT
  • Colissimo Home without signature: Home delivery: €5.90 incl. VAT

In the event of a failure to meet our delivery obligation on the date indicated or within the planned timeframe, you may cancel your order via registered letter with acknowledgment of receipt or in writing (email sent to vpc@collinesdeprovence.fr).

In case of contract cancellation, we will proceed with a full refund of your purchase, including delivery costs, using the payment method used during your purchase, unless otherwise agreed by you. The refund will take place within 14 days from the date of contract cancellation.

Guaranteed Refund and Returns

If your product does not meet your expectations, have no worries. Simply return it to us in its original packaging, in perfect condition, within 14 days of delivery to:

We commit to exchanging it or, if you wish, refunding it within 15 days of its receipt by us and according to the following terms:

  • If the package is returned unopened, we will refund the price of the entire package and any shipping fees.
  • If the product is returned due to our responsibility, we will refund the product, shipping fees, and any return costs.
  • If the product is returned simply of your own volition, we will refund the price of the product and the shipping fees paid for the shipment of the package to you.

Effects of withdrawal

In case of your withdrawal from this contract, we will refund all payments received from you, including delivery costs (with the exception of additional costs arising from your choice, if applicable, of a delivery method other than the least expensive standard delivery method offered by us), excluding the costs of returning the goods, without undue delay and, in any event, no later than fourteen days from the day we are informed of your decision to withdraw from this contract. We will carry out the refund using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, this refund will not incur any costs for you. We may withhold the refund until we have received the goods back or until you have provided proof of dispatch of the goods, whichever is earlier.

Exception to the right of withdrawal

The right of withdrawal cannot be exercised for cosmetic products that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection, such as hand creams, shower gels, etc.

Warranties

You benefit from the legal warranties detailed below.

Legal warranties

We are liable for conformity defects of the goods in accordance with articles L. 217-4 (and following) of the Consumer Code and hidden defects of the goods sold, under the conditions provided for in articles 1641 (and following) of the Civil Code.

Legal guarantee of conformity

You benefit from a period of two (2) years from the delivery of the goods to act on the basis of the legal guarantee.

In case of a lack of conformity, you can choose between repair or replacement of the goods, in accordance with article L. 217-9 of the Consumer Code. However, we may choose not to proceed according to your choice if this choice entails a cost that is manifestly disproportionate with regard to the other option, taking into account the value of the goods or the importance of the defect.

If repair or replacement of the goods is impossible, you can choose between a partial refund of the price or termination of the contract, in accordance with article L. 217-10 of the Consumer Code.

During the 24 months following the delivery of the goods subject to your order, you are exempt from proving the existence of the lack of conformity.

Warranty against defects in the goods sold

You may also exercise the warranty against hidden defects in the goods sold as provided for by article 1641 of the Civil Code.

In this case, you can choose between rescission of the sale or a reduction in the sale price in accordance with article 1644 of the Civil Code.

The duration of the legal guarantee of conformity may in certain cases be incompatible with the nature of the products ordered, particularly when it comes to perishable or rapidly consumable goods (such as soap, hand creams, shower gel, etc.).

If the delivered products show obvious manufacturing defects, workmanship errors, or damage in transit, please notify us of these defects immediately or report them to the carrier. Failure to report said defects does not deprive you of the benefit of the legal warranties.

Loyalty Program

The Collines de Provence loyalty program allows you to accumulate points with your orders. To do this, simply create a customer account.

  • For each validated order, you earn points: €1 spent = 1 point. The calculation is based on the total incl. VAT of your cart, excluding cart discounts and shipping costs.
  • Points are validated 14 days after your order and are valid for 1 year from that date in your customer area.
  • Returning an order during the withdrawal period constitutes cancellation of the points.
  • At any time, you can convert your points into a voucher valid on the site in the "My rewards" tab. These vouchers can be combined with other current promotions, unless otherwise specified for the promotion in question. No minimum amount is required.
  • You can use points quickly or wait until you have accumulated several to get a larger discount voucher. Example: 150 points = €5 discount voucher.

Referral Program

Join the Collines de Provence "Referral" program: €15 discount for the referrer and €10 for the referee!

Conditions to become a "referrer":

  • Create a customer account and place your first validated order.
  • Invite your friends to be your referees.
  • You can refer multiple people.
  • To benefit from the discount voucher, your referee must place an order for a minimum amount of €15. Once the order is validated (after the 14-day withdrawal period has passed), you will receive your discount voucher.
  • You will receive your discount voucher in the form of points (450 points = €15) convertible directly into a discount voucher in the "My rewards" tab.
  • The discount voucher is generated only upon the first validated order of your referee.

Conditions to become a "referee":

  • The discount voucher will be sent by email upon registration with the referral code.
  • Use the referral link or promo code at the time of cart validation to benefit from a €10 discount on your first order of a minimum amount of €15.
  • The referral link and/or code is valid for 1 year.
  • Create a customer account and validate your first order to benefit from the discount.

Collines de Provence cannot be held liable for non-performance of the concluded contract in the event of stock shortage or product unavailability, force majeure, disruption, or total or partial strikes, particularly of postal services and means of transport and/or communications. Collines de Provence will incur no liability for any indirect damages resulting from this, operating loss, loss of profit, loss of opportunity, damages, or expenses.

Collines de Provence reminds that, pursuant to article 1124 of the Civil Code, non-emancipated minors are incapable of contracting. Consequently, orders intended for minors must be placed by parental authority.
